A convicted felon accused with a juvenile of gunning down a Beaumont man and wounding a woman during a home invasion robbery is slated to be arraigned a week from Wednesday.

Roberto Armando Gutierrez, 30, of Beaumont is charged with first-degree murder, attempted murder, two counts of robbery, burglary, a special circumstance of killing in the course of a robbery and sentence-enhancing gun and great bodily injury allegations for the March 2020 attack.

A teenage boy, whose identity was not disclosed due to his age, is also charged with murder in connection with the alleged offenses. His case is being handled in Riverside Juvenile Dependency Court.

Gutierrez, who is being held without bail at the Benoit Detention Center in Indio, is scheduled for arraignment at the Banning Justice Center on July 6. The youth is being held in Riverside Juvenile Hall. His next court date was unconfirmed.

According to Beaumont police, shortly before 9 p.m. on March 18, 2020, Gutierrez and the teen forced their way into the home of Leo Miguel DeLara in the 100 block of Myrl Drive, near Edgar Avenue, confronting the victim and a woman, identified in court documents only by her initials, “T.S.”

The defendants allegedly pulled handguns and robbed the victims, shooting both before fleeing the house, police said.

First responders arrived minutes later and found DeLara dead in the residence and the woman suffering non-life-threatening gunshot wounds, from which she ultimately recovered.

Homicide detectives had few leads to go on initially, but in January, social media posts seeking information from potential witnesses netted additional information, including descriptions of the assailants, according to police.

That culminated in the identification of Gutierrez and his co-defendant, resulting in their arrests last week.

Court records show that Gutierrez has prior convictions for auto theft, possession of controlled substances for sale and presenting false identification to law enforcement.

No information was available regarding the teen.
