A tentative settlement has been reached in a lawsuit brought on behalf of one of several girls allegedly molested by a former district teacher who was later sentenced to prison.

The suit filed in August 2018 in Los Angeles Superior Court alleged that Jose Cruz Martinez molested the now 12-year-old plaintiff, identified only as Jane Doe, on campus during the 2017-18 school year. The girl’s attorneys filed court papers on July 26 notifying Judge Kevin C. Brazile of a “conditional” settlement in the case and stating that a request for dismissal will be filed by Jan. 11.

The complaint filed against the district and Martinez on the girl’s behalf by her guardian alleged sexual battery, sexual harassment, negligence and both intentional and negligent infliction of emotional distress.

Martinez, who taught second grade at Rowland Elementary School, allegedly molested the girls on campus between Aug. 1, 2017, and April 1, 2018.

The plaintiff’s suit states she was 7 years old when she was abused.

Martinez, a Rowland Heights resident who was 54 years old when the suit was filed, was sentenced in 2018 to five years in prison for allegedly inappropriately touching the girls.

“Martinez abused his position of authority to repeatedly engage in inappropriate sexual conduct with Jane Doe…,” the suit alleged.

Much of the conditioning and sexual misconduct occurred “on school grounds and in the classroom, which was in plain sight of other administrators and staff,” according to the complaint.

In addition to inappropriately touching the girl, Hernandez painted the child’s nails and gave her “gifts and treats,” the suit alleged.

The district knew or should have known that Martinez had engaged in similar misconduct with other students, according to the suit.

In their court papers, lawyers for the district denied any liability on their client’s part regarding Martinez’s actions. The district filed a cross-complaint against Martinez for indemnity.
