Relatives of a man killed in a traffic accident in the Pico-Union area in 2020 are suing the rental car company that owned the car that allegedly rear-ended the vehicle in which the decedent was riding.
The Los Angeles Superior Court lawsuit was brought Wednesday against EAN Holdings Inc., also known as Enterprise Rent-a-Car, by Beatriz Pecor, the widow of the late 68-year-old Mark Alan Peacor, and the couple’s two sons, Henry and Ralph Peacor. The suit’s allegations include negligence and negligent infliction of emotional distress.
The Peacors seeks unspecified damages. An Enterprise representative could not be immediately reached for comment.
The driver of the Enterprise car is neither identified nor currently named as a defendant in the case.
According to the suit, the Enterprise vehicle, a black 2020 BMW, was being driven west on the Santa Monica (10) Freeway on Nov. 24 and was about 200 feet east of the Hoover Street exit when it hit a 2019 Toyota Prius being driven by Beatriz Peacor from behind in stopped traffic at about 6:30 a.m.
Mark Peacor, a passenger in the Toyota, died later that day from head trauma caused by the crash, the suit states.
The Peacors allege the BMW driver was negligent and that Enterprise failed to properly maintain, repair and inspect the car. Mark Peacor’s death has had a negative economic impact on the plaintiffs and resulted in the losses of his love, comfort and companionship, according to the suit.
