
The District Attorney’s Office declined Monday to file charges against a man arrested on suspicion of murdering a homeless man who was found in an Alhambra apartment complex.
Michael Osuna, 26, was identified as a person of interest in the case and booked on suspicion of murder less than two hours after the body of 35-year- old Francisco Marin was found early on the morning of New Year’s Eve, Alhambra police Sgt. Jerry Johnson said.
Coroner’s Lt. Larry Dietz said Marin was believed to have been homeless.
Alhambra police were notified at 2:47 a.m. Thursday about a fight going on at an apartment building at 821 W. Marino Avenue, Johnson said. They discovered Marin, who was not a resident of the complex, lying on a walkway on the complex grounds.
Paramedics were called but could not revive Marin, whose body showed no signs of injury, according to Johnson.
An autopsy will be conducted to determine the cause of death, which has not yet been ruled a homicide, according to coroner’s records.
The case was sent to the District Attorney’s Office for review and was “declined for further investigation,” according to spokeswoman Sarah Ardalani. The office did not cite a specific reason for not moving forward with charges.
Osuna was being held at Twin Towers Correctional Facility on $1 million bail, according to Sheriff’s Department records, but was expected to be released given the lack of charges.
Calls to Johnson and the Alhambra Police Department watch commander seeking more information on the status of the investigation were not immediately returned.
