Authorities say they have not filed charges against an Anaheim man who fatally shot a suspected burglar he caught rummaging through his parked vehicle.

The Orange County District Attorney’s Office is currently going over all of the details of the incident with police, spokeswoman Roxi Fyad told the Orange County Register. The shooter was not taken into custody following the incident, Anaheim Police Sgt. Luis Correa told the newspaper.

Police say 40-year-old Long Beach resident Ryan Miller was killed in the incident.

Police responded to a report of a shooting in the 100 block of South Eucalyptus Drive about 5:10 a.m. Monday, Correa said.

“A resident saw a male inside his vehicle which was parked in the driveway of his residence,” Correa said. “He exited his residence with a shotgun and a confrontation ensued. During the confrontation, the resident fired one round and the suspect fled.”

Miller was found nearby and died after being taken to a hospital, Correa said. He added that residents should contact police immediately in such situations as opposed to confronting suspects.
