An attempted murder charge was filed Wednesday against a 35-year-old convicted felon accused of attacking a man in Costa Mesa with a metal rod and chain, leaving the victim comatose.

Adan Diaz was additionally charged with two counts of assault with a deadly weapon, three counts of resisting police and one count each of burglary and battery on a police officer, all felonies, as well as a misdemeanor battery count. The criminal complaint includes sentencing enhancement allegations of causing great bodily injury to the victim and personal use of a deadly weapon.

Diaz is accused of attacking the victim Monday and resisting three police officers, including one who was injured, according to court records.

Roxi Fyad, a spokeswoman for Costa Mesa police, said she could not discuss the case because of an agreement with prosecutors not to comment on filed cases. A District Attorney’s Office spokeswoman did not immediately respond to a request for comment.

Diaz pleaded guilty in April 2015 to assault with a deadly weapon and dissuading a witness from reporting a crime, both felonies, and a misdemeanor count of resisting police. He was sentenced to five years in prison for the Jan. 23, 2014, attack.
