A former Hemet Unified School District teacher accused of molesting a girl must stand trial on a charge of committing a lewd act on a minor, a judge ruled Friday.
Allan Joseph Mikolaycik, 72, was arrested in December 2019 following a Riverside County Sheriff’s Department investigation.
After a preliminary hearing at the Banning Justice Center, Superior Court Judge Jorge Hernandez found there was sufficient evidence to warrant a trial on the felony count.
The judge scheduled a post-preliminary hearing arraignment for May 4 at the Banning courthouse. The defendant is free on a $55,000 bond.
Sheriff’s investigators allege the molestation occurred in 2015 and involved unspecified acts perpetrated by Mikolaycik.
It was unclear whether the defendant met the girl while he was teaching, or the exact nature of the circumstances.
Between 1978 and 2010, he worked at three schools within Hemet Unified — Acacia Middle School, Dartmouth Middle School and West Valley High School, according to the school district. His assignments were full-time, working different years at each school.
Shortly after his arrest, district spokeswoman Alexandra Sponheim released a statement saying that the defendant additionally worked as a substitute teacher at the schools between 2010 and 2014, at which point he retired.
“Any individual that seeks to abuse their power with children in this manner is unlawful and goes against what we value as an organization,” Sponheim said then.
The investigation was initiated in September 2019, when deputies were sent to a residence to investigate complaints made by the victim, identified in court documents only as Jane Doe. Mikolaycik was then interviewed by detectives, who spent over three months on the case before obtaining an arrest warrant.
Investigators said there may have been additional girls allegedly targeted by the defendant in the decades that he was working in the educational system, but to date, only the one case has been filed.
He has no documented prior felony convictions.
