A preliminary hearing is scheduled Friday for a man accused, along with three boys, in the shooting death of a 39-year-old Riverside resident during an attempted robbery at a park.
Joseph Lee Auciello of Riverside is charged with murder, attempted robbery and sentence-enhancing gun, great bodily injury and gang allegations in the slaying of Ubaldo Andrade.
A 16-year-old boy and two 15-year-old boys, whose names have not been disclosed due to their ages, are charged identically in the shooting. Their cases currently remain in juvenile dependency court.
The preliminary hearing at the Riverside Hall of Justice will determine whether there’s sufficient evidence to warrant a trial for Auciello.
According to Riverside police Officer Javier Cabrera, the four defendants allegedly confronted Andrade in Bryant Park on Philbin Avenue on the night of June 8, demanding that he hand over his money and other belongings.
However, the robbery went awry, and one of the boys allegedly opened fire with a handgun, critically wounding the victim, who died during surgery later that night, Cabrera said.
He said detectives quickly identified three of the four alleged perpetrators, including Auciello, and took them into custody without incident the next morning. The fourth defendant, one of the 15-year-olds, eluded capture for more than two months before he was arrested uneventfully in mid-August.
Court records show Auciello has an unrelated felony assault case pending in Riverside County Superior Court. No background details were available regarding the juveniles.
