At the request of the plaintiff himself, a judge has dismissed a lawsuit filed against the Los Angeles Dodgers LLC by a man who says he was injured after allegedly being battered without justification by security guards at Dodger Stadium during a 2021 game against the Seattle Mariners.
Los Angeles Superior Court Judge Anne Hwang’s ruling on Tuesday was “without prejudice,” meaning the door is open for Carlos Mejia to refile the case later. Mejia, of Glassell Park, has acted as his own attorney since July and appeared in court on Tuesday to ask that his case be dismissed.
Mejia maintains that as he was being ejected from Dodger Stadium on May 12, 2021, he was, without provocation, “tackled, pushed, confined” when security used excessive force against him. Mejia maintained the guards were negligently trained and supervised.
In their court papers, Dodger attorneys maintained that Mejia “engaged in conduct that warranted his ejection” from Dodger Stadium and that he also punched security guards. The court papers on both sides do not state what prompted Mejia’s ejection.
