A judge has dismissed a lawsuit filed by a man who alleged he bought both winning tickets in a nearly $400 million California Lottery jackpot late in 2023 but lost the second ticket and still wanted to collect the other half of the prize.
Los Angeles Superior Court Judge Rolf M. Treu on Friday granted a defense motion to toss plaintiff Faramarz Lahijani’s lawsuit. In his complaint, Lahijani stated he was granted only half of the $394 million from the Dec. 8, 2023, Mega Millions grand prize. He said both tickets were bought at a Chevron station on Ventura Boulevard in Encino, and that Lahijani used the same numbers he has been playing the lottery for 30 years, which were chosen by his children: 21, 26, 53, 66, 70 and the mega number, 13.
But the judge said Lahijani did not demonstrate he had an enforceable contract requiring the California Lottery to pay unclaimed winnings or a specific law mandating such a payment.
“These deficiencies appear to be fatal to plaintiff’s claims,” the judge wrote.
In his court papers, a deputy attorney general representing the lottery stated that Lahijani’s argument didn’t add up.
“Payment of a Mega Millions prize without the submission of a valid winning ticket is expressly barred by the Mega Millions game Rules and by applicable California statutes and regulations,” the lottery attorney stated in his court paper.
Lahijani brought the breach of contract suit in December 2024 and filed a claim with the lottery commission two days earlier. Lahijani’s suit, which sought the remaining $197 million, stated that he was the only winner because “by virtue of his having timely submitted the first matching ticket, plaintiff is entitled to the entirety of the jackpot.”
In a separate ruling, the judge denied a motion by Cheryl Wilson’s complaint in intervention. Wilson, who represented herself, said in a sworn declaration that she bought the winning ticket and was entitled to $97.4 million even though she admitted that she no longer has the “physical” ticket.
“I am informed and believe that the California Lottery maintains records capable of identifying the purchaser and validating ownership through retailer verification, signature, timing and transaction data,” Wilson said in her court papers, while adding that she was willing to negotiate a settlement rather than go to trial.
In his ruling, Treu noted that Wilson contended that in addition to being the winning ticket’s original purchaser and had signed it, she also maintained that the ticket was subsequently stolen by a former employer.
“Allowing intervention on the facts asserted in by Wilson would transform this action into a wide-ranging dispute over alleged theft, fraud, conspiracy and Wilson’s contractual rights,” the judge wrote.
That leaves a whole lot left to DETERMINE how 97.4 million is denied to a rightful purchaser of a lottery ticket and its proceeds. If there is no ticket because it was stolen then the contract is void? Besides the obvious which is two tickets same gas station and records prove this. Why is Lahijani not able to prove his claim with his video evidence….him purchasing both tickets? Because the video is proof that he was behind Mrs. Wilson and was given a ticket with her same numbers after requesting it. The clerk pushed a button. Wilson signed her tickets.
