A 27-year-old man was charged Tuesday with kidnapping and raping a former girlfriend in Santa Ana.
Alexis Torresmagadan was accused of waiting for the victim and kidnapping her about 2 a.m. Friday outside of her apartment, according to court records. He is also accused of taking her 2020 Dodge Durango after he dropped her off, according to court records.
The alleged victim requested a restraining order against the defendant in December. She said that on Dec. 8 “he came around to get some personal stuff that he had left behind. And when I was giving him his stuff he entered my home without me giving him an OK and grabbed a knife and put it on my neck and slapped me as well.”
The alleged victim said Torresmagadan has also taken her phone, insulted her and “forces me to have sex,” she said in the restraining order request.
She alleged that he was arrested once before on Sept. 30, 2022, following another dispute. She described him as a “dangerous person.”
The restraining order was allowed to expire on Jan. 4 when no one showed for the court hearing, according to court records. But another emergency protective order was issued following a domestic dispute between the two on March 18, according to court records.
Torresmagadan was charged with kidnapping, rape, unlawful taking of a vehicle and corporal injury on a spouse or cohabitant, all felonies. He was also charged with disobeying a domestic relations court order with injury and battery, both misdemeanors.
