A woman who alleged the California Commerce Club Inc. wrongfully denied her $70,000 in winnings from a progressive drawing play in 2022 has settled her lawsuit against the business.

Lien Bui, also known as Kimlien Bui, sued the hotel and casino in Los Angeles Superior Court on May 28, alleging breach of contract and both fraud and intentional as well as negligent misrepresentation. On Tuesday, Bui’s attorney filed court papers with Judge Maurice A. Leiter stating that the case was resolved, but no terms were divulged.

Bui had sought $70,000, plus interest attorneys’ fees, reimbursement for costs and punitive damages.

According to her suit, Bui was induced to gamble at the club in June 2022 in part by promotional announcements that invited guests to “Win a Share of $600,000 at the Commerce.”

Progressive drawings were held thrice daily and if the winner was not selected, $5,000 was added to the next progressive drawing, the suit stated.

Bui’s ticket was chosen as the winner on June 10, 2022, and the prize was $70,000, but the plaintiff was denied payment, according to the suit, which further states that the plaintiff would not have taken part in the drawing if she knew she would not be compensated.

“The representations were made with the intent to induce plaintiff’s reliance and to get plaintiff to gamble at defendant’s casino,” the suit alleged.
