The woman filed the lawsuit in Los Angeles Superior Court against the Hill Street establishment, also naming as a defendant her alleged assailant, Jaime Ayala. The plaintiff alleges assault, sexual battery, negligence and both intentional and negligent infliction of emotional distress.

A Mayan manager saw the assault in progress but instead of helping the plaintiff, he said, “Sorry, man,” to Ayala and closed the door, the suit alleges.

The suit seeks unspecified compensatory and punitive damages.

A representative for the Mayan could did not immediately reply to an email seeking comment.

According to the complaint, the Mayan was “not a safe and secure environment for women or anyone else; it was a dangerous venue where its employees, among others, were permitted to approach female patrons, stalk them seuxally assault them and rape them.”

The plaintiff was in line with a friend to enter the Mayan and attend a concert on April 30, 2014, when Ayala saw her, the suit states. He took her inside and allowed her to sit in upgraded seats, the suit states.

Once inside, Ayala followed the plaintiff every time she left her seat to go to the restroom or the bar, the suit states. The woman was frightened, but was courteous to Ayala in the hope he would leave her alone, the suit states.

After the plaintiff rejected Ayala’s request that she go with him to a secluded area, he picked her up on his shoulders despite her pleas of “Put me down” and “Stop it,” the suit states.

Ayala took her to a closed door stairway and “assaulted and raped plaintiff against her will,” the suit states. That’s when the manager allegedly opened the door to the stairway and said “Sorry, man.”

The woman escaped after the assault and told other security guards what happened, but they didn’t assist her and instead threw her out of the club, according to the suit.
