Barkochba Botach, who owns Botach Tactical at 3423 W. 43rd Place, was found guilty of one misdemeanor count each of selling large-capacity magazines and improperly exceeding the one-handgun per 30 days rule for gun sales, according to City Attorney Mike Feuer.
The conviction came after a five-day trial in which city prosecutors presented evidence that Botach sold a pair of Smith & Wesson 9-millimeter pistols, each with 17-round magazines, to Amelia Suarez, a security officer at West Los Angeles College.
As a civilian employee of the Los Angeles County Sheriff’s Department, Suarez was not authorized to make the purchases but was given an exemption reserved for sworn law enforcement officials, according to the City Attorney’s Office.
Suarez, who stated on a purchase form that she was buying both guns for herself, later gave one of the pistols to a friend who is accused of using the gun to commit a homicide.
“This conviction sends the strong message to firearms dealers that my office will aggressively enforce key gun violence prevention laws,” Feuer said.
Botach’s sentencing hearing is set for June 6 at the downtown Los Angeles courthouse.
Suarez was convicted in January in connection with the case and sentenced to 36 months of probation. She was also ordered to do 300 hours of community service and take a gun-safety class.
