One of two brothers charged with murdering their neighbor by beating him to death with a hammer and concrete blocks has been found not competent to stand trial.
Prosecutors allege that Jonathan Macias, 25, was the lookout for his older brother as Flavio Macias Jr. attacked 44-year-old Luis Segura on Aug. 24, 2015.
The beating occurred in the 13400 block of West Moccasin Street in the unincorporated community of Bassett, between Industry and La Puente.
Jonathan Macias was committed to the Department of Mental Health and will remain in custody pending a progress hearing on Aug. 7.
Trial for Flavio Macias has been tentatively set for Aug. 16.
Segura’s wife spotted the brothers trying to load Segura into his own van and called 911, according to authorities.
The brothers were arrested in the early morning hours of Aug. 25, 2015, after a standoff at their home that lasted nearly eight hours.
Tear gas was deployed to flush out the suspects, one of whom suffered dog bites, according to the sheriff’s department.
Segura died two days after the attack.
Flavio Macias, 30, was previously convicted of injuring a cohabitant in 2005, carrying a dirk and dagger in 2006 and possession of a controlled substance in 2012, according to the criminal complaint.
If convicted as charged, he could face up to 28 years to life in prison.
The competency decision was made Monday.
