A woman who has been the lead singer of two Fleetwood Mac tribute bands is suing StubHub and Viagogo for alleged unauthorized uses of her image on their websites.
Michelle Tyler’s Los Angeles Superior Court lawsuit alleges misappropriation of likeness under both common and state laws. She seeks unspecified compensatory and punitive damages as well as restitution.
Tyler also is known as Michelle Weitz. She is the lead singer and co-founder of Fleetwood Mac tribute bands Mirage: Visions of Fleetwood Mac and Bella Donna – A Tribute to Stevie Nicks.
Representatives for StubHub and Viagogo did not immediately reply to a request for comment on the suit brought Friday. The two ticket companies recently merged, according to the complaint, which alleges that Tyler’s image has been used on the defendants’ website in connection with searches for Fleetwood Mac and Fleetwood Mac tribute bands.
The plaintiff’s image was the only one used on some pages, the suit alleges.
Tyler believes the companies deliberately used her likeness and identity “for commercial gain with no regard whatsoever for her rights” and without her permission, according to the suit.
