The parents of one of two young adults struck by a truck while walking their bicycles across a Norwalk street are suing the city, the county and the driver, alleging wrongful death and negligence.

Oscar and Martha Montoya, the father and mother of 20-year-old Rosibel Montoya, filed the lawsuit Tuesday in Los Angeles Superior Court. They are seeking unspecified damages.

Montoya and her 23-year-old boyfriend, Giovanni Xavier Chaidez, were struck by a truck while walking across Rosecrans Avenue at Fidel Avenue shortly after midnight on March 8.

A crosswalk previously existed at the intersection but had been removed, and no sign was posted advising pedestrians that it no longer existed, the suit states. The complaint also alleges the road was defectively designed, and that the driver, identified in the complaint as Juan Daniel Lozano, was negligent for allegedly failing to yield to pedestrians.
