A convicted murderer released from prison after serving more than three decades behind bars for killing a woman in Indiana was sentenced Thursday to 102 years to life in state prison for the rape of a woman who was found drugged.
Arthur Eugene Lindsey, 75, was convicted in February of nine felony counts, including rape of an unconscious person, oral copulation of an unconscious person, sexual penetration by a foreign object and possession of a firearm by a felon, according to Deputy District Attorney Jon Hatami.
Jurors acquitted Lindsey of a misdemeanor charge of obstructing or delaying a peace officer.
The jury also found true allegations that Lindsey had previously been convicted in 1965 of first-degree murder and first-degree murder in the perpetration of rape for the killing of a 21-year-old woman in Indiana and for failing to file a change of address as a sex offender in 2005 in California, according to the District Attorney’s Office.
Lindsey was paroled in the late 1990s after serving 33 years in prison on the murder charge.
A parole officer discovered Lindsey sexually assaulting the woman — who was passed out — during a surprise parole check at Lindsey’s Agua Dulce trailer, according to the prosecutor.
The 29-year-old woman acknowledged that she had consumed alcohol Lindsey gave her after he offered her a ride in his BMW, but said she hadn’t taken amphetamines, opiates and benzodiazpenes found in her system, Hatami said.
Lindsey’s phone contained numerous photos of the woman while she was passed out, Hatami said.
