A 40-year-old La Habra man with a lengthy criminal record pleaded guilty Thursday to child annoyance and was sentenced to time already served in jail.

Nicholas Jonathan Alviso was sentenced to 364 days in jail for the misdemeanor and was credited with that time served while awaiting trial. As part of the plea deal, single felony counts each of contacting a minor with the intent to commit a sex offense and possession of child pornography were dismissed.

Alviso’s attorneys won a motion to exclude evidence in the case based on how a probation officer searched through the defendant’s phone, according to court records.

Alviso has a criminal record that dates back to 2002, according to court records.

Alviso pleaded guilty on March 4, 2021 to a felony count of leading police on a chase on New Year’s Eve 2020 as well as misdemeanor counts of driving under the influence of a drug, resisting arrest, possession of burglary tools and a controlled substance.

Alviso pleaded guilty to a felony count of burglary and misdemeanor counts of resisting arrest, vandalism and possession of burglary tools on Aug. 12, 2019.

Alviso pleaded guilty to two counts of burglary in June 2016,. He pleaded guilty to buying or receiving a stolen vehicle, car theft and possession of drugs and drug paraphernalia in August 2011 and to burglary in September 2002.
