A lawsuit has been filed against CVS Health on behalf of the son of a man who died in 2025 after allegedly being unable to get a prescription inhaler for his asthma.
The Los Angeles Superior Court medical negligence lawsuit was filed for the benefit of the boy by his mother. The child is the son of the late Christopher Bernard Sims. The suit seeks unspecified compensatory damages, including for the boy’s pain and suffering, as well as compensation for funeral expenses.
The suit also includes a medical malpractice survivorship cause of action brought on behalf of Sims for the pain and suffering he allegedly endured before dying.
A CVS representative did not reply to a request for comment on the suit brought Aug. 11.
According to the complaint, Sims went to the CVS store on 20th Street south of downtown on Aug. 11, 2025, and was given an incorrect prescription. After waiting hours to get the correct prescription, he eventually went home and that same night died of an asthma attack as a result of not having his prescription inhaler, according to the suit.
Sims’ son has been deprived of the love, companionship, comfort, care, assistance, affection and moral support of his father, the suit states.
