An Orange County jury rejected a man’s lawsuit alleging a Brea restaurant discriminated against him for advertising discounts for women on “Senorita Night.”
Steve Frye, who defendants’ attorneys say has filed more than 40 such sex discrimination lawsuits against companies such as Playboy and Trump National Golf Club, sued Cha Cha’s Latin Kitchen in Brea in July of last year. After a four-day trial in Santa Ana, a jury on Monday rejected the claim.
“We truly hope that this decision will send a clear message to Mr. Frye that Californians take discrimination seriously and do not take kindly to the law being abused by shameless profiteers,” said attorney Michael Grobaty, who defended the restaurant.
Frye argued in his lawsuit that the restaurant discriminated against him with “ladies night” discount specials and demanded at least $4,000 based on his two visits to the Brea restaurant.
The restaurant’s attorneys, however, argued that Frye was offered the same discounts, but he declined to order from the “Senorita Thursday” menu.
“Our client decided to stand firm against the lawsuit because the restaurant never discriminated against Mr. Frye,” Grobaty said. “In fact, Mr. Frye was entitled to order anything from the promotional menu.”
Grobaty argued Frye refused the discounts because he wanted to seek the damage claim instead.
