A 59-year-old Laguna Niguel man was charged Tuesday with brutally stabbing an acquaintance to death in the victim’s home.

Steve Richard Gilbert was charged with murder with a sentencing enhancement allegation for the personal use of a knife. If convicted at trial, he would face up to 26 years to life in prison.

Gilbert was accused of killing Thomas Robert Marston, 53, of Laguna Niguel, according to Orange County sheriff’s Lt. Mark Stichter.

The two had gotten into some sort of argument, but it was not immediately clear what prompted it, Stichter said.

Sheriff’s deputies responded to a call of an unconscious man at 9:54 p.m. Sunday in the 29000 block of Palo Drive, Stichter said. When they arrived they found Marston, who was rushed to a nearby hospital and pronounced dead.

Gilbert was quickly identified as a possible suspect and was arrested driving his vehicle in Mission Viejo, Stichter said.
