A parolee who was shot during a confrontation with Riverside police officers stemming from an alleged carjacking must stand trial for brandishing a firearm at a peace officer and other offenses, a judge ruled Friday.
Eddie Madrigal, 42, of Moreno Valley was arrested in June and spent more than a month recovering from his wound.
Following a preliminary hearing that began Thursday and concluded Friday morning at the Riverside Hall of Justice, Riverside County Superior Court Judge Sam Diaz ruled there was sufficient evidence to bound Madrigal over for trial on the brandishing count, as well as carjacking, being a felon in possession of a loaded firearm, possession of controlled substances while armed, resisting arrest and sentence-enhancing allegations of using a gun in the commission of a felony and committing a crime while on active parole.
The judge scheduled a post-preliminary hearing arraignment for Nov. 15 and left the defendant’s bail set at $1 million. He’s being held at the Robert Presley Jail in Riverside.
On the morning of June 18, Madrigal allegedly carjacked a Riverside resident, prompting an investigation by the police department’s Problem-Oriented Policing team, who tracked down the stolen car about 10:30 a.m. that day in the 6600 block of Palm Avenue, near Central Avenue, and signaled the driver — Madrigal — to stop, according to Riverside Police Department spokesman Officer Ryan Railsback.
“(He) … failed to pull over and turned into an apartment complex, where he continued to the rear of the property,” Railsback said. “(Madrigal) quickly exited the carjacked vehicle holding a handgun. One of the officers fired his duty weapon, striking him.”
No officers were injured, and the defendant’s alleged cohort, whose identity was not disclosed, remained seated in the front passenger seat. He was detained at the scene but ultimately not arrested in connection with the alleged carjacking.
The carjacking victim, whose identity was not disclosed, was not hurt.
Madrigal underwent surgery at Riverside Community Hospital and was later transferred to recuperate in the jail infirmary.
Jail records indicated he had been in custody at the Smith Correctional Facility in Banning for alleged parole violations, but he was released on his own recognizance three days prior to the alleged carjacking.
