Two men and a woman pleaded guilty Tuesday for their part in a break-in at a Newport Beach home where a resident shot one of the burglars, while another suspect apparently took his own life.
Andrew Miguel Rosas, 25, pleaded guilty to burglary, kidnapping for ransom-extortion or to commit a robbery, attempted robbery, possession of a gun by a felon and conspiracy, all felonies, with sentencing enhancements for being armed with a gun in the commission of a felony. Rosas was sentenced to six years in prison.
Co-defendant Jose Guadalupe Hernandez, 42, pleaded guilty to burglary, kidnapping for ransom-extortion or to commit a robbery, attempted robbery in a house and conspiracy, all felonies, with sentencing enhancements for being armed with a gun. Hernandez was sentenced to nine years in prison.
Bernadette Cortez pleaded guilty to the same charges as Hernandez and was sentenced to six years in prison.
According to Newport Beach police, two suspects entered the house April 16 in what investigators believe was a targeted attack, and a homeowner fired shots at them.
Rosas was accused of breaking in about 4:45 a.m. in the 100 block of Vista Luci, police said.
Officers arrested a wounded Rosas at the scene and began searching for a second suspect, who was found dead in bushes outside the home from an apparently self-inflicted gunshot wound to the head, Newport Beach Sgt. Steven Oberon said.
The name of that suspect has not been released.
Police said there were four people inside the home when the apparent home-invasion took place — a man, two women and a child. It was unclear who fired the shots.
The suspects brought zip ties and rope and attempted to take the victim’s cell phone to prevent them from calling police, the complaint alleges.
Rosas “has prior convictions as an adult and sustained petitions in juvenile delinquency proceedings of numerous and of increasing seriousness,” the complaint alleges.
