A man and a woman have dropped their recently filed lawsuit against the Rose Bowl Operating Co. in which they alleged inadequate security led to them being beaten by another fan while attending a Rüfüs Du Sol concert at the Rose Bowl this summer.
Attorneys for Shelby Lynn Elston and Cain Thomas Stephens Webb filed court papers Friday with Alhambra Superior Court Judge William A. Crowfoot asking that their clients’ case be dismissed “without prejudice,” meaning it can be refiled later. No reason was given for the dismissal request.
According to the suit, Elston and Webb attended the concert on Aug. 16 when they were “violently and viciously assaulted” into unconsciousness by Julio Cesar Lopez Zavala, another patron who allegedly attacked the plaintiffs and others during the event. Elston and Webb said they suffered physical injuries and mental anguish and also have incurred medical expenses. They contended that the Rose Bowl had inadequate security.
The suit, filed Oct. 3, does not state the relationship between the plaintiffs.
