Attorneys for one of Sumner Redstone’s female former companion wants a judge to order a mental examination by an impartial expert of the ailing billionaire as part of her defense against an elder abuse lawsuit Redstone filed against her.
The court papers filed Monday in Los Angeles Superior Court by Manuela Herzer’s legal team state that the 94-year-old Redstone’s complaint against the woman and another past female friend, Sydney Holland, raises “numerous questions about Sumner Redstone’s mental health and capacity.”
Herzer was in control of Redstone’s care until 2015, when she and Holland were told to leave his Beverly Park home.
“An independent medical examination would shed light on the existence, causes, severity and duration of any mental health issues,” Herzer’s lawyers state in their court papers. “If ordered by the court, the exam will be in Sumner Redstone’s home, on his timetable and at his convenience.”
Redstone sued Herzer and Holland last Oct. 25. The suit seeks to reclaim $150 million in gifts he had given them and alleges both women manipulated and emotionally abused Redstone to get what they wanted, including jewelry, designer clothing, real estate and cash.
Holland, 45, dated Redstone for five years. In her cross-complaint against Redstone’s daughter, Shari Redstone, Holland alleges the latter violated her privacy and induced a breach of contract because the media mogul had previously agreed to provide financial support to Holland and her daughter for the rest of their lives.
Both Herzer and Holland question whether Redstone is in control of the lawsuit.
Herzer’s lawyers state in their court papers that attempts to negotiate an agreement with Redstone’s attorneys to permit his medical examination have failed, just as they did when Holland’s counsel made the same proposal.
“Enough is enough,” Herzer’s lawyers state in their court papers.
A hearing on Herzer’s motion is scheduled July 20.
