A man has dropped his lawsuit against “Beverly Hills 90210” cast member Ian Ziering stemming from a fight the actor had with multiple mini-motorbike riders on New Year’s Eve in 2023.

Jacob Hernandez’s Los Angeles Superior Court lawsuit alleged battery, assault, negligence, malicious prosecution and both intentional and negligent infliction of emotional distress. On Tuesday, his attorney filed court papers with Judge Richard S. Kemalyan asking that the case be dropped “with prejudice,” meaning it cannot be refiled.

Hernandez had sought unspecified compensatory and punitive damages. However, media reports stated both sides agreed to end the litigation without any recovery of damages.

In a sworn declaration, the 62-year-old Ziering said he was stopped in traffic on Hollywood Boulevard between Highland Avenue and Orange Street with his daughter seated in his vehicle on Dec. 31, 2023, when he was “swarmed” by members of a minibike group known as the 605 gang.

“After I exited my vehicle, I was attacked by several 605 Gang members,” Ziering said. “During the attack, one of the 605 Gang members smashed the windshield while my daughter was still inside. Broken glass entered the vehicle where she was seated.”

Ziering said his comments about what happened were limited to reporting the crime to law enforcement, cooperating with the investigation, and making two general social media statements acknowledging the incident without identifying Hernandez.

According to the suit, Hernandez, then 20, and his fellow bikers rode from downtown Los Angeles to Hollywood on Dec. 31, 2023. He says they found themselves in heavy traffic and that at one point Ziering, without provocation, got out of his car and started yelling at the plaintiff in a threatening manner.

Ziering allegedly shoved Hernandez with both hands, causing the plaintiff to fall into his female friend to his right and both of them tumbled to the pavement along with their bikes, the suit stated.

“After plaintiff and his female friend were able to get off the ground, a melee occurred between defendant and multiple individuals who came to the aid of plaintiff and his female friend, ” according to the suit, which additionally says the confrontation was recorded on video.

Hernandez still suffers from physical and emotional injuries, including panic attacks, and his motorbike was damaged and needed numerous repairs, the suit stated. Ziering rushed to give his side of the story and claimed he was the victim, never stating that he was the one who started the altercation when he pushed Hernandez, the suit filed Dec. 29 further stated.

Hernandez was arrested in May 2024, but never charged, the complaint stated.
