
Maywood City Councilman Sergio Calderon has resigned from his position to settle a lawsuit filed by the District Attorney’s Office accusing him of holding two public offices that created a conflict of interest, prosecutors said Wednesday.
The District Attorney’s Office sued Calderon in November 2016, contending it was a conflict for him to serve on both the Maywood City Council and the Water Replenishment District of Southern California board.
According to the lawsuit, “the WRD and the city of Maywood have overlapping territory, duties and responsibilities, and a clash of duties is likely to arise in the exercise of both offices simultaneously.”
With the suit set to go to trial Jan. 25, Calderon resigned from the Maywood City Council on Dec. 13, and the lawsuit was dismissed Dec. 26.
This is the second time Calderon has resigned from the Maywood City Council to resolve a lawsuit over the same issue. Calderon was sued by the District Attorney’s Office in 2008 for serving on both bodies, but Calderon resigned from the council before the suit went to trial.
Calderon was reelected to the council in 2015.
